The Town of Marion’s Board of Aldermen met Tuesday, April 11, 2023 at 7:00 p.m. at the Marion Fire Station for their regular business meeting. Members present included: Mayor Danny A. Smith, Aldermen Mark Andrews, Bubba Hoggatt, and Alderwoman Rhonda Davis. Guests included Clerk Johnnie Baker, Assistant Clerk Cheryl Geoghagan, Chief of Police Montral Ferguson, and Water Superintendent Jimmy Caldwell. Alderman Channing Washington and Alderman Erik Redd were absent. Mayor Smith called the meeting to order and Assistant Clerk Geoghagan gave the invocation. Clerk Johnnie Baker led the pledge of allegiance and then Mayor Smith welcomed the guests.
Mayor Smith opened the floor for public comments. There being no comments Mayor Smith closed the public comments session.
On motion by Alderman Hoggatt, second by Alderwoman Davis to approve the March 20, 2023 regular business meeting minutes. Motion carried.
On motion by Alderwoman Davis, second by Alderman Andrews to approve the budget to actual/financial report comparisons. Motion carried.
The water tank rehab has been completed and is back in operation.
The town has been approved for a $25,000 Community Water Enrichment Fund Grant FY 2021-2022. The grant will be used to replace old chlorination equipment at several water sites.
Marion Mayhaw pageant will be May 6th @ the Marion gym at 6:30PM. The festival is May13th, and the banquet will be May 25th. Bruce Hampton will be sponsoring the banquet.
Mayor Smith advised the town was not funded for the KLB Recycling Startup Grant. Mayor Smith will apply again at the next round.
The town was approved for a $3,000 Claiborne Electric Roundup Trust Grant.
The new gutter system has been completed at the Marion Council on Aging building. Sheriff Dusty Gates paid half the cost on this project.
The council, mayor, and guests discussed enforcing ordinances that are in place for maintenance of property. A committee will be formed to review the ordinances in place and making recommendations on needed changes.
A CenterPoint Easy Match Grant has been applied for. The grant will be for the Police Department.
The Council was advised that Stacy Caldwell submitted a letter of resignation effective 3/31/23.
On motion by Alderwoman Davis, second by Alderman Hoggatt to adopt Resolution 2023-02, a proclamation making April 2023 Fair Housing Month. Motion carried.
On motion by Alderman Andrews, second by Alderman Hoggatt to ratify the hiring of Michael Nolan as a part time police officer as recommended by Chief Ferguson. Motion carried.
Water Superintendent Caldwell advised there have been some street signs vandalized. Mayor Smith suggested the signs be replaced.

Marion has received five trash receptacles from a Keep LA Beautiful Grant.
Mayor Smith reported on Stacy Caldwell’s employment status.
Marion Mayhaw Pageant will be Saturday, May 6, 2023, Mayhaw Fest Saturday, May 13, 2023, and Mayhaw Banquet Thursday, May 25, 2023.
Marion Love the Boot Cleanup & Beautification Day is Saturday, April 22, 2023.
Marion has applied for an $8,000.00 Keep LA Beautiful Grant. The grant will be used to start a recycling program.
Marion has submitted a Claiborne Electric Roundup Trust application for improvements to our Council on Aging/Triad building.
On motion by Alderman Hoggatt, second by Alderwoman Davis to adopt Section 32 Requirements in its entirety and future revisions. Motion carried.
On motion by Alderwoman Davis, second by Alderman Andrews to adopt the Municipal Water Pollution Prevention (MWPP) Resolution 2023-1. Motion carried.
On motion by Alderman Hoggatt, second by Alderman Washington to amend the current town curfew with penalties. Motion carried. Sunday through Thursday 10:00 PM – 5:00 AM and Friday through Saturday 11:00 PM – 5:00 AM.
Chief Ferguson discussed the Police Department budget with Mayor Smith and the Council.
Assistant Clerk Geoghagan took notes for street light outages and missing or damaged signs. She will report these to Claiborne Electric and the LA DOTD respectively.
Alderman Washington gave a report from the Ward 2 Recreation District Committee. They are now offering a fitness class on Mondays and Wednesdays and also are starting some new activities such as a Cornhole game.
On motion by Alderwoman Davis, second by Alderman Redd to hire Chandler Smith for a part time patrol officer as recommended by Chief Ferguson. Motion carried.
Chief Ferguson is working with Claudia Wade on securing a $75,000 - $150,000 grant for three camera trailers.
Chief Caldwell advised the fire department will be doing pump and hose testing in 2023.
Water Superintendent Caldwell advised all departments are doing well other than some problems with the garbage truck.. Also, the Water Department is working towards replacing the water filters at the well on Highway 33.

Mayor Smith gave updates on the Family Dollar/Dollar Tree, Garbage Truck Search, Water Tank Rehab Project, Marion Community Health Resource Fair, and the employment status of Stacy Caldwell.
On motion by Alderman Hoggatt, second by Alderman Redd to deem the Dodge Charger Unit as surplus property and at the recommendation of Chief Ferguson to donate the unit to the Ward 3 Deputy Constable for an “in kind” donation. Motion carried.
Street Light Outages were reported and Assistant Clerk Geoghagan will report the outages to Claiborne Electric.
Mayor Smith advised he applied for a Claiborne Electric Round Up Trust Grant for the Marion Council on Aging Building Improvements.
On motion by Alderman Andrews, second by Alderman Hoggatt to continue the contract with Skyway Towers which is currently in place. Motion carried.
On motion by Alderman Redd, second by Alderman Washington to accept the Audit Engagements Letter from Maxwell CPA for the 2022 Financial Audit. Motion carried.
On motion by Alderman Hoggatt, second by Alderman Andrews to approve the Audit Questionnaire for 2022. Motion carried.
On motion by Alderman Washington, second by Alderwoman Davis to increase the requirement amount for a purchase order from $500 or greater to $1,000.00 or greater. Motion carried.
Chief Ferguson reported the Marion Police Department received $4,100 from a Claiborne Electric Round Up
Trust Grant. These funds will purchase five bullet proof vests.
Water Superintendent Caldwell advised that Tuesday, January 21, 2023 there will be Fireman’s Conference hosted by Sadie/Tiger Bend at the Marion Fire Station.
Water Superintendent Caldwell advised that new tires were bought for the town garbage truck.
Mayor Smith advised the town had been approved for approximately $5,000 from a Keep LA Beautiful Grant. The funds will pay for trash receptacles to be placed at the Main Street Park and Marion Sports Complex.
Mayor Smith advised he will be looking into starting a recycling program and he will apply for a Keep LA Beautiful Grant.
Mayor Smith stated the Mayhaw Festival will be May 13th, 2023 and the Timberfest will be December 2nd, 2023.
Alderman Washington gave a report from the Marion Recreation Committee. The recreation committee is partnering with Richard Hinkle to utilize the Marion gymnasium for youth recreational activities.

Mayor Smith reported that he has asked the DOTD to schedule David Wade Correctional Trustees to clean up trash on all state highways coming into Marion. The council discussed getting DOTD to clean up some ditches that are creating drainage problems and hazardous driving conditions from the run off when there are heavy rains.
Mayor Smith announced the DART meetings are the 3RDWednesday of each month at the fire staion @ 11:00 AM. He encouraged everyone to attend.
Mayor Smith announced there will be a health fair on Saturday, February 11th @ the Marion Community Center from 10:00 AM till 2:00 PM.

On motion by Alderman Andrews, second by Alderman Washington to appoint Johnnie Baker as Town Clerk and Tax Collector, Jimmy Caldwell as Public Works Director, and Joseph Cusimano as Town Attorney. Motion carried.
Bubba Hoggatt was elected as Mayor Pro Tem by acclamation.
On motion by Alderman Hoggatt, second by Alderwoman Davis to award Southern Coatings, LLC the contract to repair and repaint the elevated water tank subject to concurrence by the Office of Community Development and to authorize Mayor Danny A. Smith to sign documents associated with the project. Motion carried.
On motion by Alderman Hoggatt, second by Alderwoman Davis to table the renewal of the Concord Water System/Marion Water System Agreement. Motion carried. This item will be voted on very soon at a special council meeting.
Chief Ferguson gave a report on the Police Department and shared his aspirations are for the Town of Marion Police Department.

AN ORDINANCE ESTABLISHING WATER RATES, SEWER RATES, GARBAGE
RATES, CHARGES FOR WATER METER TAPS AND WATER METER DEPOSITS
BE IT ORDAINED by the Mayor and Board of Alderman of the Town of Marion, in regular
legal session convened, that the rates, charges and deposits, in connection with water, sewer
and garbage services provided by the Town of Marion are hereby established, to wit:
WATER: RESIDENTIAL RATES
$30.00 per month for the first 2000 gallons of water
$ 4.00 per thousand or part thereof for all water over 2000 gallons
COMMERCIAL RATES
$40.00 per month for the first 10,000 gallons of water
$ 4.00 per thousand or part thereof for all water over $10,000 gallons
SEWER: RESIDENTIAL

Introduction of Ordinance 2022-02 – 2023 Budgets by Alderman Andrews
On motion by Alderman Andrews, second by Alderman Hoggatt to ratify accepting the
donation of the John Drago property and approving payment of legal fees to Joe Cusimano for
transaction of property. Motion carried.
Street Light Outages were discussed and Assistant Clerk Cheryl Geoghagan will report these
findings to Claiborne Electric.
Mayor Smith gave an update on Stacy Caldwell and indicated Stacy is waiting on a release
from his doctor.
Mayor Smith presented appreciation plaques to Lindsey Redd and Jeffrey Kirkland for their
years of service on the Marion Town Council.
On motion by Alderwoman Davis, second by Alderman Andrews authorizing Mayor Smith to
execute and submit FY-2023 LCDBG application on behalf of the Town of Marion. Motion
carried.
On motion by Alderman Kirkland, second by Alderwoman Redd to award the Administrative
Contract for the LCDBG FY-2023 to Frye Magee LLC, subject to OCD approval. Motion
carried.
+On motion by Alderman Andrews, second by Alderman Hoggatt to award the Engineering
Contract for the LCDBG FY-2023 to Riley Company of LA. Motion carried.
On motion by Alderman Hoggatt, second Alderman Andrews approving the letter to OCD-
LGA requesting permission to move forward on the project to repair and repaint the elevated
water tank prior to completing the required water rate study under the Water Sector Program.
Motion carried.
The Council discussed adjusting the Mayor’s salary.
On motion by Alderman Andrews, second by Alderwoman Redd to pay bills. Motion carried.

The Town of Marion’s Board of Aldermen met Thursday, July 21, 2022 at 4:00 p.m. at the Marion
Fire Station for a special business meeting. Members present included: Mayor Danny A. Smith,
Aldermen Bubba Hoggatt, and Mark Andrews and Alderwomen Rhonda Davis and Lindsey Redd. Guests included Clerk Johnnie Baker, Water Superintendent Jimmy Caldwell, and Assistant Water Superintendent Stacy Caldwell. Jeffrey Kirkland and Chief Mark Dodd was absent. Mayor Smith called the meeting to order and Alderwoman Davis gave the invocation. Alderman Hoggatt led the pledge of allegiance.
On motion by Alderwoman Davis, second by Alderman Hoggatt to approve the agenda. Motion
carried.
On motion by Alderwoman Davis, second by Alderman Andrews to extend FMLA (Family
Medical Leave Act) and medical coverage until Stacy Caldwell’s doctors provide a release for him
to return to work or until the doctors state they can’t let Stacy continue working. These benefits
have been extended because Stacy holds water and waste water certifications. A roll call vote was taken with the following result:

On motion by Alderwoman Davis, second by Alderman Andrews to amend the documented Water System Collection Policy and Procedure. Owners of rental property are responsible for any outstanding balance when their renter vacates the property. Any unpaid balance must be paid by the property owner before water service will be provided for a new renter.
Effective, July 21, 2022, the required deposit for water service is $200.00 for renters.

RESOLUTION 2019-03
MILLAGE: GENERAL ALIMONY 7.43 mills
The official resolution is on file for viewing at the Town of Marion offices located at 398 Main St. Marion, LA 71260.
BE IT RESOLVED, that the following millage(s) are hereby levied on the 2019 tax roll on all property subject to taxation by Town of Marion:
BE IT FURTHER RESOLVED that the proper administrative officials of the Parish of Union, State of Louisiana, be and they are hereby empowered, authorized, and directed to spread said taxes, as hereinabove set forth, upon the assessment roll of said Parish for the year 2019, and to make the collection of hte taxes imposed for and on behalf of the taxing authority, according to law, and that the taxes herein levied shall become a permanent lien and privilege on all property subject to taxation as herein set forth, and collection thereof shall be enforceable in the manner provided by law.
The foregoing resolution was read in full, the roll was called on the adoption thereof, and the resolution was adopted by the following votes:
